Nothing is more stressful than finding yourself out of work and without income. Unemployment benefits are available to help soften the financial blow while you seek new employment. Once you have applied for unemployment benefits, both you and your former employer will get a Notice of Determination regarding your eligibility for benefits. If either you or your former employer disagree with the decision, you will have 15 days to appeal it.
If either party decides to appeal the Notice of Determination, there will be a hearing scheduled in front of a UC Referee. These appeals are not easy to win, especially if you are going in unprepared and unrepresented. During this hearing, both sides will have the opportunity to provide evidence and testimony to support their claims. This is far more difficult than it sounds due to the fact it follows the Pennsylvania Rules of Evidence â think âobjection your honor.â Some believe you can just go in and tell your story, and even if unopposed, if you will be fine. Wrong. We have so many terrible stories of this going tragically wrong because the Claimant said one incorrect thing. After this hearing, the Referee will make their decision based on the evidence provided at this hearing and within 2 weeks both parties will be mailed a copy of the decision.
If youâve quit, the burden falls entirely on you to prove that you had good reason for it. You are most likely to be found ineligible if you quit voluntarily without ânecessitous or compelling reason.â If you believe you did have valid reason to leave your job, it is highly recommended that you seek the counsel of an experienced Employment Attorney to help you prepare your case. Your former employer will more than likely have their own lawyer or legal team to help them prepare and gather evidence against you.
If you were fired from your job, the burden falls on your employer (slightly) to prove that you were terminated for willful misconduct and therefore not eligible for UC benefits. Remember though, saying the wrong thing can easily make it seem like it was your fault or âyou should have knownâ what happened was wrong. Further, if you were fired for reasons you believe to be unlawful, it is recommended that you seek the counsel of an employment attorney as you may have additional claims outside of unemployment to bring against your former employer.
