Why is it important to hire an attorney to file your EEOC Charge?
When filing a Charge with the EEOC, it is important to properly allege each and every claim/act of discrimination. If you do not properly allege each act and claim of discrimination in your Charge, you may be prevented from asserting that claim in Court. This is an extremely common problem that we have seen derail cases in many circumstances. Not alleging the proper claims in an EEOC Charge, which is trickier than you may believe, may result in a lapse of the statute of limitations – meaning your case might over. Barring that as a possibility, if you fail to properly assert and articulate a claim, the EEOC investigator cannot properly investigate (meaning requesting some documents most likely at the most) your case or your case can be dismissed prematurely. That means if you ultimately do want to file a lawsuit, you will be doing so without the best available evidence; it will be weaker.

When you make a filing with the EEOC, a “check the box” filing, one written by yourself, or one done with the help of intake person at the EEOC, is often lacking the critical nuance to start your case off on the right foot. They will likely “come out swinging” and will vigorously respond. According to the EEOC:
It is in the Respondent’s [your employer] interest to provide an effective position statement that focuses on the facts. An effective position statement is clear, concise, complete and responsive. It should clearly explain the Respondent’s version of the facts and identify the specific documents and evidence supporting its position. A position statement that addresses all the allegations in the charge and provides relevant evidence to support the Respondent’s position can help EEOC accelerate the investigation and tailor its requests for additional information.

What is the Timeline of an EEOC Case:
A general timeline of a case filed with the EEOC is as follows:

- You are assigned an investigator
- An investigation ensues where the investigator will contact witnesses and investigate your claims
- The Employer may submit a position statement which is a statement outlining their defenses to your claims
- Your investigator will eventually find probable cause or issue a right to sue notice allowing you to bring your claim(s) in Court
